False Patent Marking

False Patent Marking occurs when companies are listing expired patents on their products, implying that those products were still protected by the patents. The practice of claiming patent coverage over something that isn’t properly patented is known as “false patent marking”. Patents only last for about 20 years from the date of filing the patent application. If a patent expires and a manufacturer produces a batch of products with the patent markings, it is considered mis-marked.

Over the last several years, there has been a significant increase in the number of false patent marking lawsuits filed in district courts throughout the United States. Many of these lawsuits have been based solely on an allegation that an expired patent number appearing on a product constitutes false marking, rather than an allegation that a product was marked with a patent number that did not actually apply to that product.
